These Terms of Service ("Terms") are a legal agreement between you and GrailGarage, operated by Thomas Capital Holdings ("GrailGarage," "we," "us"). They govern your use of grailgarage.co and related features (the "Service"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
You must be at least 18 years old and able to form a binding contract. By using the Service, you represent that you meet these requirements and that the information you provide is accurate.
GrailGarage provides information and tools to help you identify dealers that are likely to receive allocation of specific vehicles, draft outreach emails, track your search, and receive notifications when matching inventory appears. Dealer suggestions are curated from public volume/certification data and enthusiast knowledge and are informational only.
If you set an alert or subscribe, you authorize us to send you emails about matching vehicles and your account. You can stop alert emails at any time (reply STOP to any alert email, or cancel your subscription). We may still send essential transactional messages, such as billing notices.
We may offer an optional paid "concierge" (done-for-you) service for an additional fee described at the point of request. Any such engagement is subject to the fee and scope communicated to you and to these Terms. The concierge service does not guarantee acquisition of any vehicle.
You may submit content such as crowdsourced price reports or dealers you add. You represent that your submissions are accurate and lawful and that you have the right to share them. You grant us a non-exclusive, worldwide, royalty-free license to use, store, display, and share submitted content to operate and improve the Service (for example, showing anonymized, aggregated pricing). Do not submit false, misleading, unlawful, or infringing content.
You agree not to: use the Service for unlawful purposes; scrape, resell, or misuse the data or emails; send spam or harass dealers; attempt to breach or overload our systems; reverse engineer the Service; or infringe others' rights. We may suspend or terminate access for violations.
The Service relies on and links to third parties (including dealers, Stripe, Auto.dev, Resend, Supabase, and Netlify). Your dealings with dealers and any purchase you make are solely between you and the dealer. We are not responsible for third-party content, products, services, or practices.
The Service, including negotiation tips and pricing information, is provided for general informational purposes only and is not legal, financial, tax, or professional advice. You are responsible for your own purchase decisions.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY INFORMATION, LISTING, OR ALERT WILL BE ACCURATE, TIMELY, OR COMPLETE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GRAILGARAGE AND ITS OWNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOST PROFITS OR OPPORTUNITIES (INCLUDING A MISSED OR LOST VEHICLE), ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM (OR $50 IF YOU PAID NOTHING). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
You agree to indemnify and hold harmless GrailGarage and its owners from claims, damages, and expenses (including reasonable attorneys' fees) arising from your misuse of the Service, your content, or your violation of these Terms or applicable law.
You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or to protect the Service. Provisions that by their nature should survive (such as disclaimers, limitations of liability, and indemnification) will survive termination.
We may update these Terms from time to time. When we do, we'll revise the "Last updated" date above. Your continued use after changes take effect means you accept the updated Terms.
These Terms are governed by the laws of the state in which Thomas Capital Holdings is organized, without regard to conflict-of-laws rules, and you agree to the exclusive jurisdiction of the state and federal courts located there, except where prohibited by applicable law.
